The principal regulations governing the procedure for taking control of goods, including notice requirements, entry to premises, controlled goods agreements and CRAR. Amended to incorporate S.I. 2026/366 โ 14-day notice period and debt advice provider provisions.
Sets out the fees recoverable from debtors at each stage of enforcement โ compliance, enforcement and sale or disposal โ including the percentage element. Amended to reflect the May 2026 fee increases and updated thresholds.
The amending instrument itself. Extends the notice period from 7 to 14 clear days, introduces 28-day extensions where a debt advice provider requests it, updates fee scales, and revises the prescribed Notice of Enforcement form.
The primary Act of Parliament governing enforcement in England and Wales. Part 3 and Schedule 12 introduced the modern regime for taking control of goods, replacing the ancient law of distress and creating the framework for CRAR.
